Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of websites operated by Avio Group Company Limited (“Avio Group”) — including aviogroup.eco — and the Vitaro mobile and web experiences we make available (collectively, the “Services”).

By creating an account, downloading Vitaro, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree, do not use the Services. We may refuse service, suspend accounts, or limit features where permitted by law and these Terms.

2. Description of services

Vitaro is a behavior-support platform designed to help users reflect on challenges, identify patterns, and follow structured, self-development-oriented protocols. Avio Group provides software infrastructure, educational content experiences, and related communications as described in-product.

Features may evolve during development and release phases. We may add, modify, or retire features to improve safety, quality, or compliance. We will provide reasonable advance notice for materially adverse changes to paid offerings if and when they exist.

The corporate website provides general information about Avio Group, verification information, and links to legal documents. It does not, by itself, provide personalized coaching or clinical services.

3. User accounts and responsibilities

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account unless you notify us promptly of unauthorized access.

You must be old enough to use the Services under applicable law in your jurisdiction. You may not share accounts in ways that circumvent security, licensing, or abuse detection.

We may require re-verification, password resets, or additional authentication where we detect suspicious activity or as required for regulatory compliance.

4. Acceptable use

You agree not to misuse the Services. Prohibited conduct includes: attempting to probe, scan, or test the vulnerability of our systems without authorization; interfering with other users; uploading malware; reverse engineering except to the limited extent permitted by law; harvesting data without consent; or using the Services to stalk, harass, or harm others.

You may not use automated means to access the Services in ways that impose unreasonable load, circumvent rate limits, or scrape personal data. You may not impersonate Avio Group, our staff, or other users.

We may investigate violations and cooperate with law enforcement where legally required. Repeat or serious abuse may result in termination.

5. Intellectual property

Avio Group and its licensors own all rights in the Services, including software, branding, logos, documentation, and curated content, subject to open-source licenses where applicable.

You retain rights to content you create and submit (“Your Content”). You grant Avio Group a worldwide, non-exclusive license to host, process, transmit, display, and adapt Your Content solely to operate, secure, improve, and provide the Services and as described in our Privacy Policy.

Feedback you provide may be used by Avio Group without obligation or compensation, except where prohibited by law. You may not remove proprietary notices or misuse Avio Group trademarks.

6. Disclaimer of medical and clinical claims

Vitaro is a behavioral-support platform. It is not a medical device, not a substitute for professional mental health treatment, and not designed to diagnose, treat, cure, or prevent any disease or psychological condition. The protocols, content, and guidance provided through Vitaro are educational and self-development tools. They do not constitute medical advice, psychological treatment, or therapy. If you are experiencing a mental health crisis, suicidal thoughts, or symptoms of a serious mental health condition, please contact local emergency services or a licensed mental health professional immediately. Avio Group is not responsible for outcomes that result from using Vitaro as a substitute for professional medical or mental health care.

Nothing on aviogroup.eco or within Vitaro creates a clinician–patient relationship. If you require clinical services, consult qualified professionals in your jurisdiction.

You are responsible for seeking urgent help when needed. Do not rely on the Services as your only source of safety planning.

7. Limitation of liability

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Avio Group and its affiliates, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from your use of the Services.

Where limitation cannot apply by law, our aggregate liability for claims arising out of the Services will not exceed the greater of (a) the amounts you paid to Avio Group for the Services in the six months preceding the claim, or (b) fifty U.S dollars (USD) if no fees were paid. Multiple claims do not expand this cap.

8. Termination

You may stop using the Services at any time and may request account deletion as described in our Privacy Policy.

We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or if we discontinue a product with reasonable notice except where immediate termination is legally required.

Upon termination, certain provisions that by their nature should survive — including intellectual property, disclaimers, limitations of liability, and governing law — will survive.

9. Changes to terms

We may modify these Terms to reflect changes to our Services or legal requirements. We will post updated Terms with a revised “Last updated” date and, where material, provide additional notice through email or in-app messaging when Vitaro is generally available.

Continued use after changes become effective constitutes acceptance unless applicable law requires separate consent. If you disagree, discontinue use and delete your account where available.

We archive prior versions internally and can provide copies on reasonable request for transparency.

10. Governing law

These Terms are governed by the laws of Vietnam, excluding conflict-of-law rules that would require applying another jurisdiction’s laws, subject to non-waivable consumer protections where you reside.

Venue for disputes will be courts located in Vietnam with competent jurisdiction, unless mandatory law gives you the right to bring claims elsewhere.

You may have additional rights under local consumer regulations that these Terms cannot override.
